Fine for Digging a Well Without a License: Important Information
According to “Al-Yawm Al-Sabea” newspaper, Abaar Group reports that digging a well without a license can lead to fines of up to 200,000 pounds.
This is based on the new Water Resources and Irrigation Law No. 147 of 2021. The government is expected to officially publish the law soon, after the Prime Minister’s approval.
The law includes 169 rules, covering different aspects of water resources, including public and private activities.
It also explains the steps and paperwork needed to get a license for any work involving water wells.
There are technical and regulatory rules that licensed individuals must follow, especially for groundwater.
The law clearly states that no one is allowed to dig a groundwater well,
whether shallow or deep, for any purpose without getting a license from the Ministry of Water Resources and Irrigation.
Getting a License:
Companies and individuals who want to dig groundwater wells must first get a license.
If anyone digs without a license, they will face fines from 20,000 to 200,000 pounds, and if they repeat the offense, the fines will be higher.
Additionally, the equipment used for illegal digging will be confiscated.
A special committee will be created to review license applications.
The Prime Minister will form the committee, and it will send its recommendations to the minister for approval.
Once the minister approves, other authorities must follow.
The Ministry will also do technical studies to find and protect groundwater sources, and set policies for their use.
They will monitor how much water is being used and its quality.
If someone sells the land where a well is located, the new owner must notify the relevant authority, and the license will be updated.
If this doesn’t happen, both the old and new owners will be held responsible for following the law.
